Welcome to Examify ("Service"), provided by Alexia Technology Sdn Bhd ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Examify platform, including our website, mobile application, and all associated features and services.

By accessing, registering for, or using Examify in any way, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service. We recommend reading these Terms carefully before proceeding.

    ⚠️ Important: Examify is an educational resource to support learning. It is not a substitute for formal medical education, professional medical advice, clinical training, or examination preparation under qualified supervision. Always rely on your institution, mentors, and qualified educators as your primary source of guidance.

1. Service Description

1.1 What is Examify?

Examify is a medical exam preparation platform offering:

Curated question banks across medical specialties and examination formats
Multiple question types: Single Best Answer (SBA), Extended Matching Questions (EMQ), True/False, and multiple-choice
Timed and untimed exam simulations
Performance analytics and progress tracking
Study planning and learning analytics tools
Access via web browser and mobile application (iOS/Android)

1.2 Access and Subscription Model

Examify operates on a subscription basis. Access to certain exam categories and features requires an active subscription. Subscriptions are managed through WooCommerce and your account dashboard.

1.3 Availability

We strive to maintain 99% uptime for the Examify service. However, we do not guarantee uninterrupted access. Service interruptions may occur for maintenance, updates, security patches, or due to circumstances beyond our control.

1.4 Mobile Applications

Examify is available as native mobile applications for iOS and Android. Mobile app terms include:

App Store/Google Play Terms: Your download and use are also subject to the App Store (Apple) or Google Play (Google) terms of service
App Updates: Examify may automatically update the app to fix bugs, add features, or maintain security. You can control automatic updates through your device settings
Offline Access: Some features may be available offline after download; however, account sync, new content, and analytics require an active internet connection
Device Permissions: The mobile app may request permissions for notifications, camera, location, or storage. You may grant or deny these in your device settings
Third-Party SDKs: The mobile app integrates third-party SDKs for analytics, crash reporting, and push notifications. These are subject to their respective privacy policies
Platform-Specific Issues: We support the two most recent major OS versions (iOS and Android). Older OS versions may not receive updates or support

2. User Accounts and Subscriptions

2.1 Account Registration

To use Examify, you must:

Be at least 18 years old
Provide accurate, current, and truthful information during registration
Maintain the confidentiality of your login credentials
Notify us immediately of any unauthorized use of your account

2.2 Account Responsibility

You are solely responsible for:

All activity that occurs under your account
Protecting your password and login credentials
Reporting any unauthorized access or use to us immediately

We are not liable for losses resulting from unauthorized account access. If you believe your account has been compromised, contact us at info@alexiatechnology.com.

2.3 Subscription Terms

Billing: Subscriptions renew automatically on the date specified at purchase unless cancelled
Payment: You authorize Examify to charge your payment method on the renewal date
Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing period; no refunds are issued for partial billing periods
Price Changes: We may change subscription pricing with 30 days' notice. Continued use after notice constitutes acceptance of new pricing
Failed Payments: If a payment fails, we will attempt to collect payment again. Repeated failures may result in account suspension

2.4 No Refunds

Subscription fees are non-refundable except as required by applicable law. If you are unsatisfied with the Service, your sole remedy is cancellation of your subscription.

2.5 Free Trials

If we offer a free trial, your trial period expires at the date specified. You will be charged for the full subscription unless you cancel before the trial ends. Trial terms are subject to these Terms and our Privacy Policy.

3. Intellectual Property and Content Rights

3.1 Ownership of Content

All exam questions, explanations, study materials, images, videos, software, and other content provided on Examify ("Content") are owned or licensed by Alexia Technology Sdn Bhd. Except as expressly permitted, you may not:

Reproduce, copy, or distribute Content without written permission
Modify, adapt, translate, or create derivative works from Content
Use Content for commercial purposes or resale
Share login credentials or bypass access controls to allow unauthorized access
Download or extract questions in bulk or transfer them to another platform
Publish Content on social media, forums, or third-party platforms

3.1.1 Right to Update and Remove Content

Examify reserves the absolute right to:

Update Content: Correct factual errors, update outdated information, align with current clinical guidelines, or improve explanations without prior notice
Remove Deprecated Content: Remove questions, exam categories, or materials that become obsolete, outdated, or no longer aligned with current medical practice
Modify Question Parameters: Adjust question difficulty ratings, specialty classifications, exam-type associations, or other metadata
Notify Major Changes: For significant overhauls affecting entire exam categories or substantial portions of the question bank, we will make reasonable efforts to notify users via email or platform announcement

These updates are made in our discretion to maintain accuracy, quality, and relevance. Your continued access to the platform following updates means you accept the revised Content. You are not entitled to refunds because questions have been updated, removed, or corrected.

3.2 Limited License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Content solely for your private learning and exam preparation during the term of your subscription.

3.3 Trademark

"Examify" and related logos and marks are trademarks of Alexia Technology Sdn Bhd. You may not use these marks without our written consent.

3.5 User Submissions and Attribution

3.5.1 Submission of Questions, Feedback, and Annotations

Examify welcomes user submissions to improve the platform, including:

New exam questions or question suggestions
Corrections to existing questions or explanations
Additional explanations, clinical notes, or study tips
Feedback on question clarity, difficulty, or relevance
Annotations and learning notes relevant to specific topics

3.5.2 Rights to Submissions

By submitting any content to Examify, you grant Alexia Technology Sdn Bhd a worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to:

Use, publish, and display your submission on Examify
Modify, edit, or improve your submission to align with Examify standards and style
Incorporate your submission into the question bank or learning materials
Use your submission for research and quality improvement purposes

You retain authorship and credit for your submissions. You warrant that:

Your submission is original and does not infringe third-party rights
You own or have permission to grant the license described above
Your submission complies with all applicable laws and these Terms

3.5.3 Attribution and Credit

Users who submit questions, feedback, or annotations may receive public credit within Examify, including:

Name attribution next to the contributed question or correction
Public contributor profile or "Contributor" badge in your user account
Recognition in Examify contributor lists or credits page
Special recognition for high-impact contributions

Attribution is at the discretion of Examify. You may opt out of public attribution by noting this when you submit.

3.5.4 No Compensation for Submissions

Contributions to Examify are voluntary and unpaid. Examify does not provide monetary compensation for user submissions. Your benefit is public attribution, platform improvement, and contribution to medical education.

3.5.5 Quality Control

Not all submissions will be accepted. Examify reserves the right to:

Review and evaluate all submissions for quality, accuracy, and alignment with platform standards
Reject submissions that are inaccurate, unclear, or not suitable for the platform
Request revisions or clarifications before publishing
Remove published submissions if errors are identified or standards change

Submission does not guarantee publication. We will make reasonable efforts to notify you if your submission is rejected or significantly modified.

3.5.6 Submission Guidelines

All submissions must:

Be medically accurate and evidence-based
Follow current clinical guidelines and best practices
Be written in clear, accessible language
Not contain promotional content, advertising, or spam
Not infringe any third-party intellectual property rights
Comply with these Terms and our policies

4. Medical Content and Disclaimers

4.1 Educational Purpose Only

Examify is provided as an educational tool only for exam preparation and learning. The Content:

Is designed for use by medical students and professionals in formal education or training
Is not a substitute for clinical experience, supervised learning, or professional education
Must be used in conjunction with, not instead of, formal curriculum and institutional guidance
Should never be used to provide medical advice or clinical decision-making in real patients

4.2 No Medical Advice

Examify does not provide medical advice, diagnosis, or treatment. No Content on Examify should be used to diagnose, treat, cure, or prevent any medical condition. If you require medical advice, consult a qualified healthcare professional in person.

4.3 Content Accuracy

While we strive to ensure Content accuracy and currency, medical knowledge evolves rapidly. We do not warrant that:

All Content reflects current medical practice or guidelines
Content is free of errors, omissions, or outdated information
Content matches the exact format or scope of any specific examination

Users are responsible for verifying information through current textbooks, guidelines, and institutional resources.

4.4 Examination Preparation

Examify supports preparation for medical examinations, but we do not guarantee success or specific pass/fail outcomes. Examination results depend on many factors including study habits, clinical experience, institutional training quality, and individual aptitude.

4.5 Question Format and Exam Differences

Examify provides questions designed to simulate popular medical examinations and build competency. However, you acknowledge that:

Format Variations: The actual examination you sit may use different question formats, presentation styles, or interface designs than those on Examify
Content Scope: Examify questions may not cover all possible topics or question types that appear in real examinations
Difficulty Calibration: Question difficulty on Examify may differ from the actual exam
Time Pressure: Actual exam time constraints, invigilation rules, and technical platforms may differ significantly
Guidelines Evolution: Medical guidelines, best practices, and examination standards evolve continuously. Content on Examify reflects information available at the time of creation
Speciality-Specific Variations: Different countries, institutions, and examination boards may have different standards, protocols, and preferred approaches

Examify is a study and learning tool, not a perfect simulation. You should always:

Review official examination guidance and past papers from the examination body
Consult your institution's curriculum and resources
Supplement Examify with clinical experience and supervised learning
Use Examify as one tool among many in your exam preparation strategy

5. Data Privacy and Security

5.1 Data Collection

We collect and process personal data as described in our Privacy Policy (available at https://alexiatechnology.com/privacy). This includes:

Account information (name, email, login credentials)
Payment and billing information (handled by WooCommerce and payment processors)
Usage analytics (questions answered, scores, time spent, performance trends)
Device and network information (for security and analytics)

5.2 Use of Analytics Data

We use your data to:

Provide and improve the Service
Generate your performance analytics and progress reports
Personalize your learning experience
Send service updates, reminders, and educational communications
Conduct research and analyze platform trends (in aggregated, de-identified form)
Comply with legal obligations and enforce these Terms

5.3 Data Security

We implement industry-standard security measures including encryption, rate limiting, access controls, and audit logging. However, no system is perfectly secure. We cannot guarantee absolute security of your data.

5.4 Data Retention

We retain your account data and analytics for the duration of your subscription and for a reasonable period thereafter. After account deletion, some data may be retained for legal compliance, fraud prevention, or aggregated analytics.

5.5 Third-Party Services

Examify integrates with third-party services including:

WooCommerce and WordPress: For hosting, subscriptions, and user management
Auth0 (optional): For single sign-on and identity management
Payment Processors: For secure payment processing

These third parties may process your data according to their own terms and privacy policies. We are not responsible for their practices.

5.6 Future Data Export and Download Features

While not currently available, Examify may introduce features in the future that allow you to:

Export your performance analytics and scores
Download completed exams for offline review
Export your study progress and learning data in common formats (PDF, CSV, JSON)
Generate performance certificates or transcripts

When such features become available, they will be subject to the data security and intellectual property protections outlined in these Terms. Downloaded or exported content remains subject to the license restrictions in Section 3 (no redistribution, no commercial use).

6. User Conduct and Prohibitions

6.1 Permitted Use

You agree to use Examify solely for lawful, personal exam preparation and learning. You must comply with all applicable laws and regulations.

6.2 Prohibited Conduct

You must not:

Share your login credentials or allow others to use your account
Attempt to hack, breach, exploit, or gain unauthorized access to Examify systems, databases, servers, or user accounts
Conduct any form of security testing, penetration testing, vulnerability scanning, or reconnaissance without written authorization from Examify
Attempt to access, modify, delete, or interfere with the Service or its data
Reverse engineer, decompile, or attempt to derive source code of the Service
Conduct denial-of-service attacks, scans, or security testing without written permission
Use automated tools (bots, scrapers, crawlers) to extract Content
Bypass access controls or use the Service in ways not intended
Attempt to impersonate others or create false identities
Engage in harassment, bullying, or abusive behavior toward other users or staff
Use the Service for any illegal or unethical purpose
Publicly claim that Examify endorses medical advice or decisions you make
Use questions from Examify in actual patient care or clinical settings without proper authorization and supervision

6.2.1 Security Researchers and Responsible Disclosure

If you are a security researcher who has discovered a vulnerability in Examify, do not exploit the vulnerability or share it publicly. Instead, contact us immediately at info@alexiatechnology.com with:

A detailed description of the vulnerability
Steps to reproduce it
Potential impact assessment
Your preferred contact information and disclosure timeline

We take security seriously and welcome responsible disclosure. Researchers who report genuine vulnerabilities responsibly may be publicly credited and acknowledged. This exception does not apply to unauthorized access, data extraction, or testing without our explicit written permission.

6.3 Content Sharing and Copyright Infringement

Sharing Examify Content outside your personal account (via social media, other platforms, forums, or with unauthorized users) violates copyright law and these Terms. Suspected infringement will be addressed with account suspension or termination.

6.4 Right to Monitor

We reserve the right to monitor account activity for security, fraud prevention, and compliance. Unusual activity patterns may trigger investigation or account suspension.

7. Exam Access and Restrictions

7.1 Subscription Determines Access

Your subscription tier determines which exam categories you can access. Attempting to access restricted exams without a valid subscription is prohibited and may result in account suspension.

7.2 Unlimited Exam Attempts

Once you have an active subscription to an exam category, you may attempt exams unlimited times during your subscription period. There are no limits on the number of times you can:

Take timed or untimed exam simulations
Review practice questions
Retake previously completed exams
Access study materials

Unlimited attempts allow you to maximize learning, track progress over time, and build confidence before the actual examination.

7.3 License Restrictions

Exam questions are licensed for individual use only. You may not:

Use questions in a class, group, or training institution without the institution's written permission
Modify questions or answers
Mix Examify questions with other materials and claim them as your own
Sell, distribute, or sublicense access to exam questions

7.4 Institutional Use

If your institution wishes to use Examify for group learning or teaching, contact info@alexiatechnology.com to discuss institutional licensing arrangements. Institutional licenses may include:

Group subscriptions with volume pricing
Integrated learning pathways for programs or departments
Customized question banks aligned with institutional curriculum
Reporting and analytics for educators
Training and onboarding support

8. Limitation of Liability

8.1 Disclaimer of Warranties

EXAMIFY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
ALL CONTENT IS ACCURATE, CURRENT, OR COMPLETE
USING EXAMIFY WILL RESULT IN EXAM SUCCESS OR SPECIFIC SCORES
THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
THIS INCLUDES LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF USE
THIS APPLIES EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM

8.3 Medical Liability

WE ARE NOT LIABLE FOR:

Any medical decisions or outcomes resulting from use of Examify
Any consequences of incorrect or outdated medical information
Any reliance on Content for clinical care or patient management
Exam failure, poor grades, or failure to achieve certification

8.4 Applicable Law

Some jurisdictions do not allow disclaimers or limitations of liability. In such cases, liability shall be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless Alexia Technology Sdn Bhd, its directors, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

Your violation of these Terms
Your use of Examify in violation of applicable laws
Your infringement of third-party intellectual property rights
Any claims by others that your use of the Service caused harm to them
Your medical decisions or clinical practice based on Examify Content

10. Termination and Account Suspension

10.1 Termination by You

You may terminate your account at any time by contacting us or using your account settings. Termination does not entitle you to a refund of unused subscription fees.

10.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

You violate these Terms or our policies
You share Content without authorization
We detect fraudulent activity, payment failures, or security risks
You harass staff or other users
You engage in illegal activity
Your account is inactive for an extended period (as defined in our Privacy Policy)
You attempt to hack, breach, exploit, or gain unauthorized access to Examify systems, databases, or user accounts
You conduct security testing, penetration testing, or vulnerability scanning without written authorization
You reverse-engineer, decompile, or attempt to derive source code

10.2.1 No Refunds for Security Violations

If your account is terminated for hacking, unauthorized access attempts, security breaches, or similar violations, you forfeit all subscription fees and are not entitled to any refund, credit, or compensation. Violations of this nature may also be reported to relevant authorities and may result in legal action against you.

10.3 Effect of Termination

Upon termination:

Your access to the Service and Content ceases immediately
Your subscription ends; you are not entitled to refunds
Your account data may be deleted in accordance with our Privacy Policy
Provisions that should survive termination (liability, indemnification, intellectual property) remain in effect

11. Changes to These Terms

We may update these Terms at any time. Changes become effective 30 days after posting, unless they address legal compliance or security, in which case they are effective immediately. Your continued use of Examify after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or a prominent notice on the platform.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the Malaysian courts for any disputes arising from or relating to these Terms or your use of Examify.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating legal action, you agree to attempt to resolve disputes informally by contacting us at info@alexiatechnology.com with a detailed description of the issue.

13.2 Legal Proceedings

If informal resolution fails, disputes shall be resolved in the courts of Malaysia. Both parties agree to waive any right to jury trial (where applicable).

13.3 Arbitration (Optional)

By mutual written agreement, either party may elect binding arbitration under Malaysian law instead of court proceedings.

14. General Provisions

14.1 Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if impossible, severed. The remaining provisions shall remain in full effect.

14.2 Entire Agreement

These Terms, together with our Privacy Policy and any other policies posted on Examify, constitute the entire agreement between you and Alexia Technology Sdn Bhd regarding your use of the Service.

14.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign or transfer your account or rights under these Terms without written permission. We may assign these Terms to a successor company without notice.

14.5 No Partnership

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Alexia Technology Sdn Bhd.

15. User Acknowledgment

By registering for Examify, you acknowledge that you:

Will not rely on Examify for medical advice or clinical decision-making in real patients
Accept all limitations of liability and disclaimers herein
Will comply with all applicable laws and institutional policies in your use of the Service
